Algorithmic Collusion & India’s AI Regulation: The Silent Battle for Market Fairness
India’s AI future depends on balancing innovation with fair competition—addressing data dominance, infrastructure concentration, and algorithmic collusion early.
According to the Competition Commission of India (CCI), 37% of Indian AI startups already believe that AI-enabled tacit collusion is real. Algorithms adjusting prices simultaneously may seem efficient, but collectively they can choke competition.
Behind this invisible coordination lies data power. Around 68% of startups cite lack of large, clean datasets as their biggest hurdle. The cycle is self-reinforcing: more users → more data → better models → even more users. Add to that, AWS, Azure, and Google Cloud control 60% of India’s cloud market, giving them both infrastructural and stratgic leverage.
But change is stirring. The Competition (Amendment) Act, 2023 now addresses hub-and-spoke cartels and mandates scrutiny of data-driven acquisitions over ₹2,000 crore. Meanwhile, the IndiaAI Mission—a ₹10,300 crore initiative—seeks to democratize compute, data, and research access for startups through shared GPUs, open datasets, and public foundation models.
However, infrastructure alone won’t fix bias. Success depends on transparent governance, regularly updated open datasets, and research-driven collaboration between academia and industry.
India’s AI market, growing from $3.2B (2020) to $6.05B (2024) and projected to hit $31.9B by 2031, offers a narrow window to act. Once concentration sets in, reversing it becomes nearly impossible.
