Birla Opus vs Asian Paints: Antitrust Clash Heats Up

The complaint alleges that Asian Paints, which commands over 50% of India's EUR 4.5 billion (₹9.5 billion) decorative paints market, has been pressuring its network of retail dealers to shun Birla Opus products. Dealers claim they were warned of credit restrictions and threatened with supply cuts if they displayed or stocked rival brands such as Birla Opus, which has gained around 7% market share since its launch in February 2024. While Birla Opus invested about USD 1.2 billion in five plants to challenge the incumbent, Asian Paints argues that Birla’s swift market entry disproves any anti-competitive behavior. In a letter to the CCI, Asian Paints noted that Birla’s rising presence validates healthy competition and requested an opportunity to present its side before any final decision. The CCI is currently reviewing the complaint in its initial phase and determining whether a full-scale probe is warranted. If the CCI finds merit, it could escalate to its investigations unit; otherwise, the case risks dismissal. This showdown recalls a similar episode in 2022 when JSW Paints accused Asian Paints of stifling competition. That complaint was ultimately dismissed for lack of evidence, setting a precedent for cautious regulatory scrutiny. The Birla–Asian battle underscores the fierce contestation reshaping India’s paint market—sparked by Birla Opus’s aggressive strategy: rapid capacity expansion, dealer incentives, and competitive pricing. If the CCI rules in Birla’s favor, it could recalibrate dealer practices and curb market dominance. On the other hand, dismissal could reinforce incumbents’ latitude in managing distribution networks. For now, India’s paint industry awaits the CCI’s decision—a verdict that may define the future contours of competition and market conduct.
