Bombay High Court Verdict Brings Over ₹10,500 Crore Relief to Telecom Operators

India’s telecom sector received a major boost after the Bombay High Court struck down the government’s one-time spectrum charge (OTSC) demands, providing combined relief of over ₹10,500 crore to Bharti Airtel and Vodafone Idea. For $BHARTIARTL, the court quashed a demand that was initially raised at ₹5,201.2 crore in 2013 and later revised to ₹8,414 crore in 2018, including ₹473.7 crore linked to its subsidiary Bharti Hexacom for the Rajasthan and North East circles. $IDEA also benefited as the court set aside OTSC demands totaling ₹2,113 crore related to the erstwhile Idea Cellular and Spice Communications, while noting that certain claims had been revised to ₹3,322 crore in 2018 during merger approvals. The dispute dates back to 2013, when telecom operators challenged the government's decision to impose additional charges on spectrum holdings beyond specified limits. The court ruled that operators had already acquired spectrum under the revenue-sharing framework of the National Telecom Policy, 1999, and that imposing an additional levy years later lacked a valid legal or contractual basis. The judgment also directed the return of bank guarantees furnished by Vodafone Idea against the disputed claims. The ruling is expected to improve balance-sheet visibility, reduce contingent liabilities, and provide greater financial flexibility for telecom operators as they continue investing in network expansion and competing in a capital-intensive industry.
