Fortis Healthcare: Delhi HC Orders Forensic Audit

Delhi High Court has ordered a forensic audit into alleged asset dissipation by former Fortis Healthcare promoters Malvinder and Shivinder Singh. The proceedings follow Daiichi Sankyo’s claim related to a ₹53 billion arbitral award. The audit will examine alleged disposal of assets, Fortis Healthcare’s change of control and the acquisition of a stake by IHH Healthcare. The court’s order seeks to examine the transactions and circumstances surrounding the alleged asset transfers. Importantly, no monetary liability has been imposed on Fortis Healthcare under the order. The development is therefore primarily a legal and governance matter concerning the company’s former promoters, rather than a direct financial liability for Fortis.
